WEST PAPUA: POLICE AGAIN OPEN FIRE, BEAT AND ARREST PROTESTERS IN PAPUA-WIDE CRACKDOWN ON KNPB DEMOS

In several centres across West Papua on October 16, Indonesian police and army (TNI) have again cracked down violently on peaceful political demonstrations held by the West Papua National Committee (KNPB), resulting in the injuries of several participants, with unconfirmed reports of police opening fire in related incidents against KNPB members in Kaimana.
The demonstrations, called for October 15 by the KNPB to commemorate the fifth anniversary of the founding of the International Parliamentarians for West Papua, were delayed for a day out of respect for the Muslim holiday of Eid al-Adha.   The rallies were also highlighting the historic speech made by Vanuatu Prime Minister Moana Kalosil Carcasses to the United Nations General Assembly in late September, calling for the international community to take action on West Papua.........(MORE)

We know that the Guarani Kaiowa People have spent decades being driven from their ancestral lands as profit driven agricultural barons seek ever more land for ever more profit by any means necessary. The indigenous people of Mato Grosso de Sul struggle with not only disposession but with the additional issues of introduced addictions and sickness caused by inability to access and harvest traditional foods we hear their call. Today Guarani Kaiowa People are standing as one with Indigenous People from throughout Brazil to assert their rights to the Freedom so many of us in the Western First World consider they have, despite not once having to fight for or defend it. 

 When Indigenous Peoples of the World Stand to defend their way of life and their very existence we stand in solidarity with them. On February 13, Australia’s Federal Parliament will vote on the ‘Aboriginal and Torres Strait Islander Peoples Recognition Bill 2012’. This legislation is tokenistic, provides the original sovereign tribes of this continent with NO BENEFITS and is simply an attempt by the Commonwealth Government of Australia (and their corporate backers) to put off the real issues at hand – SOVEREIGNTY & TREATY.

Listed below is what the Act of Recognition will do:

1) The Parliament, on behalf of the people of Australia, recognises that the continent and the islands now known as Australia were first occupied by Aboriginal and Torres Strait Islander peoples.

2) The Parliament, on behalf of the people of Australia, acknowledges the continuing relationship of Aboriginal and Torres Strait Islander peoples with their traditional lands and waters.

3) The Parliament, on behalf of the people of Australia, acknowledges and respects the continuing cultures, languages and heritage of Aboriginal and Torres Strait Islander peoples.

Although this may sound good, none of the above enactments provide any legal basis for our claim to SOVEREIGNTY, land rights, water rights, protection of our languages or cultural heritage. This ‘Act of Recognition’ is just like Kevin Rudd’s apology – words without change.

The other part of this ‘Act of Recognition’ is what is known as a sunset clause which means that the Act will cease to exist after 2 years. After this 2 years is up, they will once again decide whether the Australian public is ready for a referendum on Constitutional recognition. As we all know, the push for a referendum on Constitutional reform (specifically the recommendations of the ‘expert panel’ which included Government appointed ‘Aboriginal leaders’ like Noel Pearson, Pat Dodson and Marcia Langton) is yet another effort to put off the question of sovereignty and treaty. Both of these efforts by Government are attempts to sell our SOVEREIGN RIGHTS, to sell our LAND RIGHTS and our SONG, DANCE & STORY.

Following some successes in the initial Global Digital Blockade in which those monitoring reported: 
  • lengthy delays in calling Canadian Embassies in South Africa and New Zealand and Canberra, Australia while the Australian Sydney Consulate closed for the afternoon.
  • Australian Canadian Embassy website offline for 43 minutes.
  • New Zealand Canadian Embassy website offline for at least an hour ten minutes.
  • extremely slow access to UK Canadian Embassy website over a period of three hours.
 Following checks and confirmation of these reports by reliable sources and in solidarity with Canadian First Nations Call for the a National Day of Action we have decided repeat our blockade tactic:

THE UNSETTLEMENT OF AUSTRALIA CEREMONY commencing at 8am at Occupy Sydney, corner Elizabeth St and Martin Place.
The ceremony will make its way to the Ceremony site at 8-30 am sharp.
The Ceremony commences with an apology by unsettlers of The Stolenwealth of Australia to aboriginal peoples for past and present injustices by Government businesses and people including but not limited to the misappropriation by whatever means of land air water culture heritage and children and the attempted cultural genocide perpetrated by past and present Federal and State Governments. Unsettlers will derecognise sovereignity by any but grassroots driven aboriginal customary people and call on the Australian Government to make immediate restoration and ongoing reparations in such manner as the grassroots aboriginal people see fit. The Australian Government will be instructed to pay the back rent owed for their time as uninvited tenants.
In return aboriginal people will return to the uncolonisers the gifts Colonisers bestowed on aboriginal people. Drug and alcohol addiction. Disposession. Diseases . Dependency. Child Abduction. Resource monopolisation. Religion. Smallpox infected blankets.
Unsettlers will row off to sea.
The people will depart for Victoria Park where from 11am Indigenous Social Justice Association will be issuing Aboriginal Passports for all non indigenous people.

On January 11th 2013 at 10 am Ottawa Time Hunger Striking Chief Theresa Spence will join a delegation of APN Canada First Nations Chiefs to meet Canadian Prime Minister Stephen Harper. There is caution in the minds of grassroots First Nations People who have borne witness to countless broken promises at the Government Altar of Broken Schemes. The immediate issue for Many First Nations is the Repeal of legislation which gives First Nations no say in the future of their local water and other resources. It is another assault on Indigenous rights and Canadian First Nations have a list of unrequited grievances which go back 500 years.

 Idle No More Sydney Stand and act in solidarity with our First Nations brothers and sisters in Canada and support their call for the Canadian government to hear and act to resolve their concerns.

Amnesty International support Idle No more

Editor’s Intro: In the letter bellow, issued yesterday, Amnesty International urges Prime Minister Stephen Harper to meet with hunger-striker Chief Theresa Spence as her peaceful protest reaches Day 18. Chief Spence is demanding a meeting involving Harper, a representative of the Queen, and First Nations leaders. She wants this meeting to discuss treaty agreements between Canada and First Nations, and dictatorship-style legislation recently passed by the Conservative majorities in Parliament. Such as the amendments proposed by the omnibus budget implementation Bill C-45, which are designed to disempower, exploit, control and marginalize First Nations. So far Harper has maintained a stubborn wall of silence over Spence’s peaceful protest.

Open Letter Urging a Meeting with Chief Theresa Spence

Dear Prime Minister:

Amnesty International is increasingly concerned over the health and well-being of Chief Theresa Spence of Attawapiskat. As you are aware, Chief Spence has said that she will continue her hunger strike until you meet with her. She is now in her third week without food.

We note that Aboriginal Affairs and Northern Development Minister John Duncan has offered to meet with Chief Spence. This, however, is not what Chief Spence has requested.

Chief Spence’s hunger strike, and the broader movement of Idle No More protests, were sparked by a federal legislative agenda that goes far beyond the Department of Aboriginal Affairs. Changes to the Canadian Environmental Assessment Act, the Fisheries Act, and the Navigable Waters Act, along with the proposed Safe Drinking Water for First Nations Act, to name only a few examples, all have profound implications for the rights of Indigenous peoples as set out in Treaties, affirmed in the Canadian Constitution, and protected by international human rights standards.

These bills and amendments should only have been brought forward after good faith consultation with Indigenous peoples and only if their rights had been appropriately considered and protected. This did not happen. The responsibility for this serious breach of Canada’s legal obligations toward Indigenous peoples lies not only with the Department of Indian Affairs, but with the Canadian Government as a whole.

The Supreme Court of Canada has said there must be “reconciliation” between the power of the state and the prior sovereignty of Indigenous peoples. Laws passed by Parliament must be balanced against the laws, customs and perspectives of Indigenous peoples and “equal weight” must be given to each. Any infringement of the Constitutionally-protected rights of Indigenous peoples must be strictly justified.

The government must always deal “honourably” with the established and asserted rights of Indigenous peoples. And in every case, in order to uphold the “honour of the Crown”, there must be good faith consultations to ensure that Indigenous peoples’ concerns are “substantially addressed.”

International human rights standards, such as the United Nations Declaration on the Rights of Indigenous Peoples, require that decisions affecting the rights of Indigenous peoples be made only with their full and effective participation. And when the decisions concern the lands and resources of Indigenous peoples, the appropriate standard is that of free, prior and informed consent.

Prime Minister, we call on you to acknowledge Canada’s responsibility to fully respect and uphold the rights of Indigenous peoples and to ensure their full and effective participation in any and all decisions that could affect these rights. We urge you to meet with Chief Spence as an immediate demonstration of your commitment to building a collaborative partnership with Indigenous peoples.
